1. Acceptance of Terms

Welcome to AxeLog. By downloading, installing, or using the AxeLog mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BestDayLabs ("we," "us," or "our") governing your use of the AxeLog application.

2. Description of Service

AxeLog is a guitar practice tracking application designed for iOS devices. The App provides the following features:

• Practice session logging and timing
• Practice streak tracking and habit building
• Long-term goal setting and progress tracking
• Song library management
• Audio and video recording capabilities
• Practice analytics and statistics
• Customizable reminders and notifications
• Theme and app icon customization

The App is designed to operate locally on your device. All data is stored on your device and is not transmitted to external servers.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the App, you represent and warrant that you have the legal capacity to enter into these Terms.

4. User Accounts

AxeLog does not require you to create an account to use the App. The App operates entirely on your local device without the need for user registration, login credentials, or cloud-based accounts.

You are responsible for maintaining the security of your device and any data stored within the App.

5. User Responsibilities

By using the App, you agree to:

• Use the App only for its intended purpose of tracking guitar practice
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App for any unlawful purpose
• Not attempt to circumvent any security features of the App
• Maintain backups of any important data stored in the App

6. Intellectual Property Rights

The App, including its original content, features, functionality, design, and code, is owned by BestDayLabs and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

The AxeLog name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BestDayLabs. You may not use such marks without our prior written permission.

7. In-App Purchases and Payments

The App is free to download and use. Optional premium features are available through the "Supporter Pack" in-app purchase.

7.1 Supporter Pack

The Supporter Pack is a one-time, non-consumable in-app purchase that unlocks:

• Additional premium themes
• Practice session templates
• Custom app icon variants
• All widget sizes

7.2 Payment Processing

All payments are processed through Apple's App Store. By making a purchase, you agree to Apple's Terms and Conditions for in-app purchases.

7.3 Refunds

Refund requests are handled by Apple in accordance with their refund policies. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

8. User-Generated Content

The App allows you to create and store certain content, including:

• Practice session notes and ratings
• Song library entries and metadata
• Audio and video recordings
• Goal descriptions and notes

You retain all rights to the content you create within the App. This content is stored locally on your device and is not uploaded to or accessible by us.

You are solely responsible for any content you create and store within the App. We do not have access to, nor do we review, your user-generated content.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle information in connection with your use of the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BestDayLabs SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your device or data
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any errors or omissions in any content
• Loss of data stored within the App

12. Indemnification

You agree to defend, indemnify, and hold harmless BestDayLabs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

13. Termination

You may terminate your use of the App at any time by deleting the App from your device.

We reserve the right to terminate or suspend access to the App immediately, without prior notice, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide notice through the App or by other means.

Your continued use of the App after any changes to the Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The State of Alabama, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the App shall be resolved in the courts of The State of Alabama.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BestDayLabs regarding your use of the App and supersede all prior agreements and understandings.
