Agreement to Terms

By downloading, installing, or using Remmy ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

Description of Service

Remmy is a sleep-companion app for iOS. When you start a sleep session, it listens with your microphone and captures short clips of sleep-talk, snoring, and other sounds, then surfaces the highlights for you in the morning. Speech is transcribed on your device. The App is intended for personal entertainment and curiosity.

Not a Medical Service

Remmy is not a medical device and does not provide medical advice, diagnosis, or treatment. It does not detect, diagnose, or monitor sleep apnea or any other medical or sleep condition. Do not rely on the App for any health, medical, or safety purpose. If you have concerns about your sleep or health, consult a qualified professional.

Eligibility

You must be at least 13 years old to use the App. By using Remmy, you represent that you meet this requirement.

Recording Responsibly

Remmy records audio in your environment during a sleep session. You are responsible for how you use it. Laws about recording audio vary by location and can apply when other people are present or may be heard. You agree to use the App only where you are permitted to record, and not to use it to record other people unlawfully or without any consent required by law.

Subscriptions and Purchases

Remmy is offered as an auto-renewing subscription through Apple's App Store, which may include a free trial. Current pricing is shown in the App before you subscribe (for example, a weekly plan following a 3-day free trial, and an annual plan). By subscribing you agree to the following:

• Payment is charged to your Apple ID account at confirmation of purchase.
• If your subscription includes a free trial, any unused portion of the trial is forfeited when you purchase a subscription.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
• You can manage or cancel your subscription in your Apple ID account settings after purchase.
• Refunds are handled by Apple in accordance with Apple's policies; we are unable to process refunds directly.

Acceptable Use

You agree to use the App only for its intended personal purpose. You may not:

• Reverse-engineer, decompile, or disassemble the App
• Use the App to unlawfully surveil or record others
• Redistribute, resell, or sublicense the App
• Use the App in any way that violates applicable laws

Your Content

Recordings and their transcripts are stored on your device and belong to you. We do not receive, access, or store them. If you choose to share a clip or card using iOS's share features, you are responsible for what you share and where.

Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee:

• The accuracy of sound capture, transcription, or detection (which depend on your device, environment, and iOS)
• That every sound or word will be captured, or captured correctly
• Uninterrupted or error-free operation

Remmy does not provide medical, diagnostic, or health outcomes of any kind. Do not rely on it for such purposes.

Limitation of Liability

To the maximum extent permitted by law, Best Day Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
