Best Day Labs respects the intellectual-property rights of others and responds to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. This page explains how to reach our designated agent, what a notice must contain, and how we handle it.

1. Designated agent

We have registered a designated agent with the United States Copyright Office to receive notifications of claimed copyright infringement:

Please use the subject line "DMCA Notice" so your message is routed correctly. This address is monitored for copyright matters; for anything else, contact support@bestdaylabs.com.

2. Submitting a notice of claimed infringement

To be effective under the DMCA, your written notice must include all of the following:

a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
identification of the copyrighted work claimed to have been infringed;
identification of the material that is claimed to be infringing and information reasonably sufficient to let us locate it — please include the song title and, where possible, a direct link or screenshot;
your contact information (name, address, telephone number, and email);
a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Notices that omit these elements may not be effective and may delay our response.

3. What we do when we receive a notice

On receipt of an effective notice we will remove or disable access to the material expeditiously, and where applicable notify the user who submitted it, including a copy of the notice. We do not adjudicate the underlying dispute; removal is not a finding that infringement occurred.

4. Counter-notices

If you believe your content was removed or disabled as a result of mistake or misidentification, you may send a counter-notice to dmca@bestdaylabs.com containing:

your physical or electronic signature;
identification of the material that was removed and the location where it appeared before removal;
a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
your name, address, and telephone number; and
a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original notice or their agent.

We will forward an effective counter-notice to the original complainant. If they do not notify us within ten business days that they have filed an action seeking a court order to restrain the activity, we may restore the material in not less than ten and not more than fourteen business days after receiving the counter-notice.

5. Repeat infringers

We maintain and reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

6. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.

7. A note on how Keys works

Keys converts audio into note data so people can learn to play songs on a piano. Transcriptions consist of note data only; we do not host or distribute the original sound recordings. Source audio is processed privately and deleted automatically shortly after transcription. Users are responsible for the material they import, as set out in our Terms of Service.
