1. Acceptance of Terms

By downloading, installing, or using Days in State ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Days in State is a location tracking application that helps users document which states and countries they visit. The App:

• Uses GPS to detect your location
• Records which jurisdictions you visit each day
• Stores data locally on your device
• Optionally backs up data via your private iCloud account
• Generates reports for documentation purposes

3. Not Tax or Legal Advice

Important: Days in State is a documentation tool only. The App:

• Does NOT provide tax advice
• Does NOT determine tax residency
• Does NOT calculate tax obligations
• Does NOT guarantee accuracy for any legal purpose

You should always consult qualified tax and legal professionals for advice regarding your specific situation. The App tracks WHERE you were and WHEN—interpretation of that data for tax purposes is your responsibility.

4. User Responsibilities

You are responsible for:

• Ensuring the accuracy of any manually entered data
• Reviewing and confirming automatically detected locations
• Maintaining backups of your data if desired
• Consulting appropriate professionals before making tax decisions

5. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle (or rather, don't handle) your data. In short: your location data stays on your device and in your private iCloud account. We never see it.

6. Subscriptions and Payments

The App offers both free and paid features:

• Free: Basic state tracking with 30-day history
• Pro: Full history, exports, calendar view, and iCloud backup

Pro is available as a monthly subscription, annual subscription, or one-time lifetime purchase. All payments are processed by Apple through the App Store. Subscription terms, pricing, and cancellation are governed by Apple's policies.

7. Refunds

Refund requests are handled by Apple in accordance with App Store policies. We do not process refunds directly.

8. Intellectual Property

The App, including its design, features, and content, is owned by Best Day Labs. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee:

• Continuous, uninterrupted access to the App
• That the App will be error-free
• The accuracy of GPS-based location detection
• That the App will meet your specific requirements

10. Limitation of Liability

To the maximum extent permitted by law, Best Day Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, any tax liability, penalties, or legal consequences that may result from reliance on data provided by the App.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend access to the App for violations of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
