1. Acceptance of Terms

By downloading, accessing, or using the Nerve mobile application ("the App"), operated by Best Day Labs ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Nerve is a screen time management utility that utilizes Apple's Screen Time APIs to restrict access to user-selected apps. Users can temporarily unlock blocked apps by answering brainteaser questions provided within the App.

3. Subscription Terms

Nerve requires an active paid subscription to function.

4. In-App Purchases

The App may offer consumable in-app purchases, such as "Cooldown Skip Packs". These consumable items are non-refundable once purchased and consumed. They are tied to your Apple ID and cannot be transferred.

5. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. Best Day Labs makes no warranties, expressed or implied, regarding the App's reliability, accuracy, or suitability for your specific needs. We are not responsible for any specific screen time outcomes or habit changes. Furthermore, Nerve relies heavily on Apple's Screen Time APIs, which may have inherent limitations, bugs, or changes outside of our control.

6. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
