Terms of Service

1. Acceptance of these terms

By downloading, installing, or using the Bounce mobile application (the "App"), operated by Best Day Labs, LLC ("we", "us", or "our"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. What Bounce does

Bounce takes a TikTok video URL that you share into the App, extracts a list of songs mentioned in that video, and creates a corresponding playlist in your Apple Music library. The App requires an active Apple Music subscription provided by Apple in order to write playlists.

3. Eligibility and account

You must be at least 13 years old, or the minimum age required by law in your country, to use the App. The App does not require you to create an account with us; access to Apple Music is handled by Apple under your Apple ID.

4. Subscription terms

Bounce is offered on a freemium basis with optional auto-renewing subscriptions:

• Free tier: one (1) lifetime free conversion. After your free conversion is used, an active subscription is required to create additional playlists.
• Bounce Pro Monthly: $4.99 USD per month, auto-renewing.
• Bounce Pro Annual: $29.99 USD per year, auto-renewing.
• Payment: all charges are billed to the Apple ID associated with your device at confirmation of purchase.
• Auto-renewal: subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of that period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.
• Manage or cancel: you can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings under "Subscriptions" after purchase.
• Pricing changes: if we change the price of a subscription, we will notify you in advance and give you an opportunity to cancel before the change takes effect.
• Refunds: all purchases are processed by Apple and are subject to Apple's refund policies.

5. Apple Music required

The App's core function depends on Apple Music. You must have an active Apple Music subscription and authorize Bounce to access it via Apple's MusicKit framework. Apple Music is provided by Apple under its own terms and is not included with a Bounce subscription.

6. Acceptable use

You agree to use Bounce only with TikTok URLs that are publicly accessible and that you have the right to view. You agree not to:

• use the App to violate any law or third-party right, including copyright;
• attempt to reverse-engineer, scrape, or interfere with our backend service;
• resell, sublicense, or commercially redistribute the App or its outputs;
• use automated means to submit URLs at a rate that interferes with normal use of the service.

7. Third-party content and services

Bounce processes content originated by third parties (TikTok videos and Apple Music catalog data). We do not own that content and we are not affiliated with TikTok or Apple. The App may be unable to extract a list, may extract an imperfect list, or may match a song to the wrong track. The accuracy of any extracted song list is provided on a best-effort basis.

8. Intellectual property

The App, our website, and all related software, designs, and trademarks are owned by Best Day Labs, LLC and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the App for its intended purpose. All rights not expressly granted are reserved.

9. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any extracted song list will be accurate or complete.

10. Limitation of liability

To the maximum extent permitted by law, Best Day Labs, LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the App. Our aggregate liability for any claim arising out of or relating to the App is limited to the amount you paid us for the App in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your access to the App at our sole discretion if you breach these Terms or use the App in a way that risks harm to us or to others. You may stop using the App at any time and may cancel any active subscription through your Apple ID Account Settings.

12. Changes to these terms

We may update these Terms from time to time. If we make a material change, we will update the effective date above and, where appropriate, notify you within the App. Continued use of the App after the change takes effect constitutes acceptance of the revised Terms.

13. Apple-specific terms

You acknowledge that these Terms are between you and Best Day Labs, LLC, not between you and Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

14. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in Delaware, unless applicable law requires otherwise.
